WHAT KIND OF INFORMATION DOES PHOTOSHOTS COLLECT?

In order to use the Photoshots website, we may require information from you in order to provide the best service possible.

In using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

Any information collected by Photoshots Ltd may occur when collected via correspondence from you or your company. This may include but is not restricted to via the telephone, email, mail, text messaging, directly through our website, registering with our newsletter, placing an order, contacting us with a question or concern, when you book a shoot, or participate in a promotion.

 

HOW DOES PHOTOSHOTS LTD USE MY INFORMATION?

  • To process and fulfill your order, including to send you emails to confirm your order status and shipment, which may also include correspondance regarding suspended orders or abandoned shopping carts.

  • To enhance your photoshoot, ordering +/or delivery experience

  • To protect the security or integrity of our website and our business
  • To detect, prevent and address technical issues
  • To contact you if necessary, which may include newsletters, marketing or promotional materials and other information that we believe may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link.

 

HOW DO I ACCESS OR CHANGE MY INFORMATION?

You may review or update your personal information by contacting us by email at [email protected]

Promotional correspondence by post or email directly to customers is not common, and for customers accessing Photoshot’s School / Event Purchase and Download portal, promotional contact is not anticipated at all. If you prefer not to receive promotional information, such as information about special offers, company news and updates, you can let us know by emailing [email protected]. You can choose to opt out of any email promotional communications that you do receive, by clicking unsubscribe at the bottom of any promotional email sent by Photoshots.

If you ask us to remove your name and address from promotional lists, this will be recorded in an Intuit Mailchimp database to ensure that we can honour your request. It may take up to 5 working days to process your email request, during which period you may continue to receive communications from Photoshots. DATA USAGE

Photoshots may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information for any other purpose.

Photoshots does not knowingly share any information with third parties for any unrelated uses.

 

HOW DO I KNOW MY PERSONAL INFORMATION IS SECURE?

The security of your personal information is important to us.

While we implement the above security measures on this site, you should be aware that 100% security is not always possible. We do our best to provide you with a safe experience. Photoshots restricts employee access to the databases that contain personal data, and employees are advised of the importance of confidentiality.

When you enter sensitive information (such as credit card numbers) on our website, Photoshots does not store any Credit Card details.

The processing of all card payments via the Fine Art Print Gallery and School / Event Purchase & Download sections are handled by Queensberry Ltd.  You can find their privacy policy here: https://www.queensberry.com/online-privacy-policy.

Photoshots Ltd will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Photoshots Ltd will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

PHOTOGRAPHS & DISPLAY GALLERIES

Where we are asked to photograph at schools, kindergartens, sports clubs or other organisations with minors, it will be standard practise to provide proofing photos online with password protection. Any related online web gallery will be provided as part of www.photoshots.co.nz, with IT and print lab operations supported by Queensberry Ltd, based in Auckland, New Zealand.

Password details may be provided at the time of photography to known associates of the organisation being photographed (ie teachers, coaches, parents etc). Post event, password & access details will only ever be provided to a sole representative of the organisation who has asked for photographs. This will be disseminated at their discretion within their respective community. Photoshots will not provide gallery passwords by email or phone to unverified enquiries. In the event an enquiry is made directly to Photoshots, details may be provided where that enquirer is already known to Photoshots, or has an established sales history.

Photoshots will work with all client organisations to respect any known protection order or privacy concern, as it may relate to any individual or group. Any privacy concern is best established prior to photography. If not known prior, ideally this is made known to Photoshots before any gallery details are shared with the respective community. Options can be explored to facilitate separate access for such content where a genuine need has been established.

In the event any individual may request the removal of an individual photo, this will be accommodated. In the event any individual may request the removal of a group photo, this will be accommodated where practical based on general consideration to all others, after consultation with the organisation / group concerned. There are various levels of password & gallery protection available. The best approach will be determined in conjunction with each organisation. The outcome will be a balance of privacy, administration workload (either by Photoshots and/or the oganisation in question), which may also have some affect on the cost of goods sold.

NZIPP / AIPA Standard Photographic Terms and Conditions of Engagement will apply for all photographic jobs. These terms can be referenced at the footer at www.photoshots.co.nz. This covers the ability by Tony Stewart or Photoshots to use imagery for the purpose of self promotion, and to provide imagery to each organisation for archival use. In the event images are used for self promotion by Tony Stewart or Photoshots, there will be an honest attempt to minimise any associated identifying details such as names.

Photoshots and Tony Stewart use the NZIPP / AIPA Standard Photographic Terms and Conditions of Engagement for all photographic undertakings. Subsequently Photoshots and Tony Stewart both elect to contract out the 1994 Copyright Act, and neither accepts photographic commissions. Image files are provided to all clients under license. License terms can be viewed within the metadata embedded with all files.

 

LEGAL

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website, to prevent or investigate possible wrongdoing in connection with the Service, to protect the personal safety of users of the Service or the public, to protect against legal liability.

 

LEGAL BASIS FOR PROCESSING PERSONAL DATA UNDER GDPR (General Data Protection Regulation)

If you are from the European Economic Area (EEA), Photoshots Ltd legal basis for collecting and using the personal information is described in this Privacy Policy  and depends on the Personal Data we collect and the specific context in which we collect it.

Photoshots Ltd may process your Personal Data because:
